Senaka De Silva’s plea to travel abroad denied

The Colombo High Court today rejected an appeal by Senaka De Silva, an aide to former Army Commander Sarath Fonseka, for permission to travel abroad to receive medical treatment.

Senaka De Silva’s attorney Upul Jayasuriya had previously appealed to the court seeking permission for him to travel to Singapore on July 02 to receive treatment.

The senior state counsel had strongly objected to this stating that the defendant was released on bail by the Appeals Court and therefore only it has the legal capacity to provide permission in this regard.

Rejecting the appeal Colombo Chief High Court Judge Sunil Rajapaksa stated that the appellate court had granted bail to Senaka De Silva under several special conditions and that one of the conditions was that he should present his passport to the High Court.

The bail order clearly states that the defendant should not be allowed to leave the country, he said.

Therefore, the Judge stated that he cannot issue an order which contradicts an order issued by the Court of Appeals and informed Fonseka’ former secretary to appeal to that court if he wishes to travel abroad.
