The Supreme Court today rejected the preliminary objections raised by MPs Vijitha Herath and R. Sampanthan and said that the Attorney General can appeal against the Appeals Court judgment delivered in favor of former Chief Juctice Dr Shirani Bandaranayake.
The appeal was filed by the AG stating that the writ of certiorari issued by the Court of Appeals quashing the Parliamentary Select Committee (PSC) report on the impeachment of the former Chief Justice could set a bad precedent.
Parliamentarians R. Sampanthan and Vijitha Herath had objected to the granting of special leave to appeal to the Attorney General against a Court of Appeal order.
Respondents Sampanthan and Herath had complained that they were not notified of the date of filing of the appeal by the Attorney General.
