The Delhi High Court today (21) declined to entertain a Public Interest Litigation seeking a ban on Bangladesh from all international cricket competitions over alleged violence against the Hindu community.
A division bench led by Chief Justice Devendra Kumar Upadhyaya said the plea was not legally maintainable, as it involved matters of foreign policy and international relations, which fall exclusively within the executive’s domain.
The court observed that writ jurisdiction under Article 226 cannot be extended to foreign governments, international bodies like the ICC, or cricket boards of other countries. It also noted that Indian courts cannot issue directions affecting another nation or conduct inquiries beyond Indian territory.
The bench warned that the petition amounted to misuse of PIL jurisdiction and could attract heavy costs for wasting judicial time. After repeated objections from the court, the petitioner, a law student, sought permission to withdraw the plea. The court allowed the withdrawal and advised pursuing more constructive legal work.
