UPDATE: Malaka Silva released on bail

Malaka Silva and Rehan Wijeratne, who were remanded over the alleged assault on an Army Major, were released on bail by the Fort Magistrate’s Court today.

Fort Magistrate Kanishka Wijeratne ordered the duo released on a cash bail of Rs. 50,000 and a personal bail of Rs. 1 million each, Ada Derana court reporter said.

Malaka, Rehan and the Army Major in question were yesterday ordered to appear before the court today (September 21).

The son of Public Relations and Public Affairs Minister Mervyn Silva, Malaka and others surrendered to the Slave Island police on September 17 over the alleged assault on the Major.

They were produced before Colombo Fort Magistrate and remanded until September 24.

It was reported that the Army Major was injured and hospitalized after the assault which took place at a five-star hotel in Colombo on September 8.

However, the Army Major, via an attorney, filed an affidavit before the Fort Magistrate on Tuesday (18) stating that he was not assaulted by Malaka Silva and agreeing to settle the issue.

The Major, attached to the Intelligence Unit of the Sri Lanka Army, addressing court today stated that the unfortunate incident had occurred due to him experiencing sudden distress and that he regrets it.

The judge then inquired if he had experienced similar distress while on duty in the North East during 16 years of service, to which the intelligence officer replied saying he had not.

However, he added, that due to excessive bleeding he was unable to identify the individuals at that instance.

The judge, pointed out that legal action can be taken against him for filing a false complaint, instructed police to conduct appropriate investigations.

The Colombo Crimes Division was ordered to inform the court on September 24 regarding further action to be taken regarding the army officer while the other persons arrested along with Malaka and Rehan were remanded till that date.
