Court of Appeal issues notice to respondents of Kadirgamar land case
Mobitel inner 1278

The Court of Appeal has issued notice on the respondents in the case filed by assassinated former Foreign Minister Lakshman Kadirgamar’s son, S.J.C. Kadirgamar against the acquisition of his father’s land in Jaffna by the government.

The petition states that the former Foreign Minister’s property now owned by his son was exclusively allotted to him by a Jaffna District Court decree in May 1968.

His son is now seeking interim relief from the courts, to prevent the respondents and their agents from taking any steps to act upon the acquisition notice until after the case is heard.  The Minister’s son is also seeking a mandate in the nature of a writ of Certiorari quashing the purported acquisition notice published under Section 2 of the Land Acquisition Act.

The petition also claims that that he is being unlawfully prevented from returning to his land through the setting up of barbed wire fences and barricades which are also manned by armed forces and also through the unauthorised construction taking place near the property.

Minister of Lands and Land Development Janaka Bandara Tennakoon, A. Sivaswamy, Land Acquiring Officer of the Jaffna District and the Land Survey Officer of the Jaffna District have been mentioned as respondents.
