Petition to remove Gihan Kulatunga from Thilina Gamage’s case rejected

The Court of Appeal rejected a petition filed by former Magistrate Thilina Gamage seeking an order to replace Justice Judge Gihan Kulatunga from the trial on keeping an elephant calf without valid a license with a new judge.

The decision was passed by Appeal Court Justices Mahinda Samayawardena and Priyantha Fernando, today (05).

The petition filed by former Magistrate Thilina Gamage pointed out that a case filed against him by the Attorney General for keeping an elephant calf without valid a license is currently being heard before Colombo High Court Judge Gihan Kulatunga.

The petitioner claims that he cannot expect justice done for him in the manner in which the case is being heard by Judge Kulatunga.

Therefore, the petition seeks a court order replacing Justice Kulatunga with a new judge to hear the case and an interim injunction to suspend the proceedings of the trial heard at the Colombo High Court.

However, the Court of Appeal rejected the petition without considering it, stated Ada Derana reporter.
