Court to proceed with FR petition against dumping garbage in Muthurajawela

The Supreme Court today (1) granted permission to take up for hearing the Fundamental Rights petition filed against the disposal of garbage collected from the city of Colombo at the Muthurajawela site. 

 

The bench of three judges informed that the petition will be taken up for hearing on March 12 next year, Ada derana correspondent reported.

 

The Supreme Court issued an order prohibiting the Colombo Municipal Council (CMC) from disposing garbage at Muthurajawela .

 

The Supreme Court has also issued a permanent injunction preventing the discharge of garbage into the Muthurajawela conservation zone by CMC.

 

The Supreme Court had also stated that the order will be effective until the final determination of the petition.

 

The Attorney representing the Colombo Municipal Council informed the Supreme Court that the disposal of garbage at Muthurajawela had completely halted.

 

Steps have been taken to dispose garbage at a land which belongs to Land Reclamation and Development Corporation, informed the Attorney representing the CMC. 

 

The bench of three judges also ordered the Forest Conservation Department to prepare a map per the gazette notification issued regarding the Muthurajawela forest conservation. 
  
A petition was filed by several residents in the area seeking a court order against the disposal of garbage collected from the city of Colombo at the Muthurajawela site. 

 

The petition stated that waste is being disposed in Muthurajawela despite the area being named an Environmental Conservation Zone, and that this has resulted in several environmental and health issues surfacing.
