The bail application filed on behalf of MP Johnston Fernando, who is currently remanded, has been rejected by the Court of Appeal.
The order was given jointly by judges Janak de Silva and Achala Vengapulli for a petition filed stating that the remanding of MP Johnston Fernando until his case concludes is illegal.
The petition stated that there is a case filed at the Kurunegala High Court against him, on the allegations of financial irregularities at Sathosa during the past government.
He points out that he had previously been bailed by the High Court for the same case and he had neither violated any bail conditions nor absconded from the court in those occasions.
When such is the case, it is against the law for the judge to be remanding him until the end of the case when the trial hasn’t even begun yet, says Fernando in the petition.
Therefore, he had pleaded for the order of the Kurunegala High Court to be declared invalid and to release him on bail until the decision on the petition arrives.
