AG informs of inability to lay by cases before judiciary pending political victimization probes

Replying to a letter sent by the Acting IGP, the Attorney General has advised of his inability to lay by emblematic cases before judicial fora pending political victimization investigations.

 

In a letter dated 2020.02.02, the Acting IGP C.D. Wickramaratne had written to Attorney General Dappula De Livera regarding investigations carried out and ongoing investigative process of the Criminal Investigations Department (CID), Financial Crime Investigation Division (FCID) and Special Investigations Unit (SIU). 

 

The Acting IGP had stated that the committee appointed to investigate into allegations of political revenge from state officials and armed forces personnel had requested from him the completed and ongoing investigative reports pertaining to FCID and SIU investigations into state officials.

 

He also proposes to temporarily lay by these emblematic cases before the judiciary until investigations determine whether the FCID, CID or SIU had carried out impartial investigations on these cases. 

 

However, in response to this the Attorney General in his letter to the Acting IGP states that he and his officials are duty-bound to proceed with legal affairs pertaining to complaints in the absence of an order by a court stating otherwise. 

 

The AG further states that commissions have no authority to issue an injunction order on a case being heard before a court of law and that commission also have no authority to issue any orders to the Attorney General regarding proceeding with the affairs of any cases.
