The Catholic Bishops’ Conference in Sri Lanka (CBCSL) has expressed concern over the Cabinet decision to increase the existing statutory retirement age of judges, stressing the need to safeguard judicial independence and the separation of powers.

 

In a statement, the CBCSL referred to the Cabinet decision published on July 27, 2026, which cited the need to retain experienced judges amid an increase in the number of courts and the planned regional operation of Courts of Appeal.

 

The Bishops’ Conference said the independence of the Judiciary, the rule of law and the doctrine of separation of powers must be upheld and protected at all times.

 

It stressed that an independent and impartial Judiciary is essential to ensuring justice, protecting fundamental rights and preserving human dignity and the common good of citizens.

 

The CBCSL said any constitutional amendment to increase the retirement age of judges should be designed to further strengthen the independence of the Judiciary.

 

According to the Conference, such an amendment should primarily seek to retain experienced judges, address the shortage of judicial officers and tackle delays in the administration of justice.

 

The CBCSL also called for adequate public and stakeholder consultation before proceeding with the proposed constitutional amendment.

 

The statement was issued by Rt. Rev. Dr. Harold Anthony Perera, President of the CBCSL, and Rt. Rev. Dr. P. Anton Ranjith, Secretary General.
